Either parent may request a modification of their existing child support order when there has been a significant and continuing change within the household, such as:
Do I qualify for a modification?
You will be asked to provide your financial information and complete the following form along with supported documents:
We will collect financial information from both parents. A modification may be appropriate if the current support order would increase or decrease by at least 15% or $50 a month, whichever is less. You may also file for a modification on your own through your local court.
How do I request a modification?
How do I withdraw my modification request after the process has started?
The modification review may result in an increase or decrease in your monthly child support amount depending on the current circumstances of both parents. Generally, the process will continue regardless of whether the child support amount increases or decreases.
Do I need an attorney to represent me?
You are not required to have an attorney for the process, but you always have the right to hire private counsel.
When does the new amount go into effect?
The new monthly child support amount will be on the order signed by the judge. The child support amount typically begins the first day of the month after the date of the court hearing.
What if the other party doesn’t turn in any information?
DCSS will review all financial information available through our various sources.
How long does the modification process take?
DCSS should complete the review and modification within six (6) months, however, this may vary according to the court schedule.
